Windham is a town of lakes and rivers. It sits on Sebago Lake, and its other waters include Little Sebago Lake, Highland Lake, Forest Lake and Pettingill Pond, just off Route 302 in North Windham. The Presumpscot River flows out of Sebago Lake and on past South Windham, and the Pleasant River comes in from Gray to join it. The town also counts brooks such as Black Brook and Colley Wright Brook among its waters, and the Black Brook Preserve covers 105 acres off Windham Center Road.

The Rules Where You Live

Windham's shoreland zone covers land within 250 feet of great ponds, rivers and freshwater wetlands, and within 100 feet of streams, where Maine's minimum is 75 feet. In the Resource Protection and Stream Protection districts, clearing vegetation for anything other than timber harvesting needs a permit from the Code Enforcement Officer, and Resource Protection allows none within 75 feet of a great pond except to remove safety hazards. In Limited Residential and General Development, clearing needs no permit but still has to meet the standards.

Windham's detailed clearing standards are in Chapter 185 of its code, and a town can be stricter than the state. Maine's minimums:

A buffer strip along the water: 100 feet at great ponds and rivers that flow to them, and generally 75 feet elsewhere.
Within that strip, no canopy gap bigger than 250 square feet, no more than 40% of the volume of trees 4 inches or more across cut in any 10 years, and plants under three feet tall left standing.
Past the buffer, clearings capped at 25% of the lot area or 10,000 square feet, whichever is greater.

Do I need a permit to clear brush near the water in Windham?

It depends on your lot's shoreland district. In Resource Protection and Stream Protection, clearing vegetation needs a permit from the Code Enforcement Officer. They can. Whether yours counts as a stream under the ordinance is a question for the Code Enforcement Office, so that's where we start.
