- Lot-wide, cleared openings in the shoreland zone, from the house to the lawn, are capped at 25% of that area or 10,000 square feet, whichever is greater (the cap doesn't apply in the General Development or Commercial Fisheries/Maritime Activities districts).
Resource Protection along Westbrook's waters
The ordinance puts land along the southerly section of Highland Lake, the southerly section of Mill Brook and its floodplain wetlands, parts of the Presumpscot River and the Stroudwater River in Resource Protection, except where the zoning map shows otherwise. Where Resource Protection borders a great pond, no vegetation may be cut within 75 feet of the water except to remove hazard trees. Elsewhere in the district, cutting is limited to what's necessary for uses the district expressly allows.

Can you clear along Mill Brook or the Stroudwater River?
Carefully, and only after the city weighs in. Elsewhere along waters other than great ponds and the rivers feeding them, the buffer is 75 feet, with no canopy gap over 250 square feet. Mill Brook also carries Highland Lake's yearly alewife run, so its banks deserve extra care.
How much of my shoreland lot can be cleared in total?
Outside the General Development and Commercial Fisheries/Maritime Activities districts, cleared openings for any purpose within the shoreland part of a lot, including the house, driveway, lawn and septic area, may not exceed 25% of that area or 10,000 square feet, whichever is greater, and land cleared earlier counts. Past the buffer, selective cutting is limited to 40% of the volume of trees 4 inches or more across in any ten years. Code Enforcement can confirm where your lot stands.
