Clearing Land in Scarborough
The town's own plan calls Scarborough Marsh central to its identity. The Maine Natural Areas Program describes it as the largest contiguous salt marsh system in Maine, covering more than 3,000 acres, about 95% of it owned and managed by Maine Inland Fisheries and Wildlife. Pine Point and Higgins Beach sit about three miles apart as the crow flies, yet the drive can take almost thirty minutes because it loops inland around the marshes. The town has village centers rather than one downtown, among them Dunstan, Oak Hill, North Scarborough and Prouts Neck.
West of the Maine Turnpike, where the town plan treats outlying land as rural, reclaiming a grown-in field, clearing a wooded lot before a build and cutting a trail all suit forestry mulching. Near the marsh and the beaches, the fit is careful brush and invasive-growth work where the rules allow it. One machine grinds it all in place, and the mulch stays put.
The Rules Where You Live
Scarborough's Shoreland Zoning Ordinance (Chapter 405C) covers land within 250 feet of great ponds, rivers and the upland edge of coastal wetlands (including all areas affected by tidal action) and freshwater wetlands, and within 75 feet of streams. Whether clearing vegetation needs a permit depends on the district:
- Resource Protection and Stream Protection: a permit from the Code Enforcement Officer (in Resource Protection, no clearing within 75 feet of a great pond except to remove safety hazards).
- Stream Protection 2, which reaches 250 feet from the Nonesuch River and from Stuart Brook east of the Maine Turnpike: a Code Enforcement Officer permit within 75 feet of the water.
- Shoreland Overlay, the rest of the zone: no permit, but the work still has to meet the ordinance's land use standards.
Clearing standards
Maine's minimum standards call for a 75-foot buffer strip along most waters (100 feet at great ponds and the rivers flowing into them). Inside the strip, no canopy opening can be over 250 square feet, and no more than 40% of the volume of trees four inches and up can be cut in ten years. Scarborough's ordinance can be stricter, and where it is, its numbers govern.
Scarborough Marsh
The marsh is tidal, so the town's 250-foot zone is measured from its upland edge. The Maine Natural Areas Program also says a buffer of 250 feet or more limits impacts from nearby development and helps prevent erosion. That's guidance, not a town rule.
Sand dunes
The Maine Geological Survey maps coastal sand dune systems at Pine Point Beach, Western and Ferry Beaches, Scarborough Beach by Prouts Neck, and Higgins Beach. Vegetation removal in a dune system requires a Maine DEP permit, and DEP says it is generally not permitted.

Scarborough Questions
Do I need a permit to clear brush near the marsh or the Nonesuch River?
Often, yes. Scarborough requires a Code Enforcement Officer permit to clear vegetation in its Resource Protection and Stream Protection districts. Along the Nonesuch River, the Stream Protection 2 overlay reaches 250 feet, with a permit needed within 75 feet of the water. Elsewhere in the shoreland zone no permit is needed, though the standards still apply. The town's zoning map shows which district your land is in.
Our house is near Pine Point Beach or Higgins Beach. What can be cleared?
First we'd check whether the lot is in a mapped dune system. The Maine Geological Survey maps dunes at Pine Point Beach and Higgins Beach. In a dune system, plants can't come out without a Maine DEP permit, and DEP says that kind of removal is generally not permitted. Lots outside the dunes can often be cleared once the town confirms the rules. We'll pull up the map for your street with you first.
Is an overgrown field west of the Turnpike a good fit?
Yes. Young trees and brush taking over an old field are just what a forestry mulcher grinds down, and the mulch stays on the ground. The town plan treats outlying land west of the Maine Turnpike as rural and calls its farms and open spaces significant features of its rural character. If a stream or wetland crosses the field, the shoreland rules above may apply there.
