Behind Kennebunkport's shoreline, most of the town is woods and wetland: its comprehensive plan puts forest at about 60% of the town's area and wetlands at about 22%. Dock Square sits on the Kennebunk River, and other villages include Cape Arundel, Cape Porpoise and Goose Rocks. Inland, the Kennebunkport Conservation Trust's Smith Preserve covers over 1,100 acres with 10 miles of trails, and its Tyler Brook Preserve follows the Batson River toward the sea.

The Rules Where You Live

Kennebunkport's Shoreland Zone, which leaves out Dock Square and the Riverfront Zone, covers land within 250 feet of tidal water, Beaver Pond, coastal and freshwater wetlands, and stretches of the Batson River, Smith Brook and Tyler Brook, plus land within 75 feet of streams. Clearing vegetation there needs a permit from the Code Enforcement Officer.

The stricter Resource Protection Zone includes every ocean island except Bickford and Goat Island and, outside Dock Square and the Riverfront Zone, the FEMA-mapped 100-year floodplain along tidal waters and rivers. Cutting there is limited to what the zone expressly allows. Elsewhere in the Shoreland Zone:

Within 75 feet of the water or a wetland, a buffer stays: no canopy opening over 250 square feet, and a point count by tree size must show a well-distributed stand remains.
No more than 40% of the volume of trees 4 inches and up can be cut in any ten years, inside the buffer or beyond it.
Plants under three feet, leaf litter and forest duff stay in the buffer, except to remove invasives, make a footpath up to six feet wide, or for other uses the buffer rules permit.
Outside Dock Square and the Riverfront Zone, all cleared openings on a lot, house and lawn included, can't exceed 25% of the lot area in the Shoreland Zone or 10,000 square feet, whichever is greater.

Sand dunes

Maine Geological Survey dune maps cover Goose Rocks Beach (three sheets, including the Batson River and Smith Brook areas) and Colony Beach. Removing vegetation in a coastal sand dune system takes a Maine DEP permit, and DEP says such removal is generally not permitted.

Invasive plants near the shore

Removing non-native invasive plants is exempt from the town's clearing limits, on conditions: machines run and park at least 25 feet from the shoreline (existing pavement or gravel aside), the first 25 feet is hand-tool work, and any area pushed past the limits gets replanted with native species. The town's other requirements still apply, and removal is limited to what's necessary.

Do I need a permit to cut trees near the water in Kennebunkport?

Inside the Shoreland or Resource Protection zones, yes. The town's guidelines say any tree removal there must be permitted by the Code Enforcement Officer with a land use permit, and a tagged tree also needs the Tree Warden's approval. Since October 1, 2026, applications go only through GovWell. We confirm with the town what applies before any work near the water.

My cottage is at Goose Rocks Beach. Can you clear around it?

Possibly, but the dunes come first. The Maine Geological Survey maps coastal sand dunes along Goose Rocks Beach. Removing vegetation in a dune system needs a Maine DEP permit, and DEP says it's generally not permitted. Land near the beach can also be Shoreland or Resource Protection. Farther back from the dunes, brush and lot work may be possible once the town signs off.

Can a grown-in field near the water be opened back up?

Sometimes. In Kennebunkport's Shoreland Zone, a field that has reverted to mostly shrubs and trees falls under the same clearing rules as other vegetation. A legally existing field that's cut at least once every two years counts as maintenance, which is exempt from those clearing standards as long as the field isn't enlarged. Away from the Shoreland Zone, reclaiming an overgrown field is a natural fit for forestry mulching.
