The Rules Where You Live

Kennebunk's zoning ordinance has a Shoreland Overlay District and a Resource Protection District, and the town's Code Enforcement Division serves as Shoreland Zoning administrator. The numbers below are Maine's minimum standards. Kennebunk's own rules can be stricter, and where they are, they apply.

Under state law, the shoreland zone reaches 250 feet from rivers, great ponds, salt water and the upland edge of coastal and freshwater wetlands, and 75 feet from streams. The state minimums for clearing in that zone:

Along great ponds and rivers that flow into them, a 100-foot strip of trees and plants stays in place (75 feet in most other spots), thinned only so a well-distributed stand remains.
In that strip, canopy gaps top out at 250 square feet, cutting is capped at 40% of the volume of trees 4 inches and up per ten years, and plants under three feet stay.
Farther back, cleared openings are held to 25% of the lot area or 10,000 square feet, whichever is greater.

Sand dunes

Parsons Beach, Great Hill, and Gooch's, Middle and Mother's beaches all appear on Maine Geological Survey coastal sand dune maps. Clearing plants in a mapped dune system needs a Maine DEP permit, and DEP's fact sheet says that kind of removal is generally not permitted.

Branch Brook water supply

Kennebunk's zoning includes a Branch Brook Aquifer Protection District. A town planning document calls wetlands in the Branch Brook watershed highly valuable for their contribution to the public water supply for Kennebunk, Kennebunkport and Wells. If your land is in that district, ask the town what it allows before any clearing.

My house is near Gooch's or Mother's Beach. Can you clear my lot?

First we'd check the dune maps. The Maine Geological Survey maps coastal sand dunes along Gooch's, Middle and Mother's beaches, and inside a mapped dune system, taking out vegetation needs a Maine DEP permit and is generally not permitted. A lot back from the dunes can still sit in the shoreland zone. Once the town says what applies, brush and lot work may be possible.

I'm on the Mousam River. What can I cut near the water?

Less than on dry ground. Under Maine's minimums, the shoreland zone reaches 250 feet from a river, and a strip of trees and plants has to stay along the water, thinned only so a well-distributed stand remains.
